실제 제출된 반성문

변명, 합리화 오랜만에 회식 자리에서 술을 마신게 화근이 되어 운전대를 잡게 되었습니다. 너무나도 제 스스로가 원망스럽습니다.

오랜만에 회식 자리를 가져서 어쩔 수 없이 음주운전을 했다는 취지의 변명으로 비춰질 수 있으며, 범죄를 합리화하려는 의도로 곡해될 가능성이 높음

과거 음주 전력이 있기에 성실하게 살아왔고 대리운전도 이용해왔습니다. 그러나 ~~오랜만에 회식 자리에서 술을 마신게 화근이 되어~~ 운전대를 잡게 되었습니다. 너무나도 제 스스로가 원망스럽습니다.

문제점.

오랜만에 회식 자리를 가져서 어쩔 수 없이 음주운전을 했다는 취지의 변명으로 비춰질 수 있으며, 범죄를 합리화하려는 의도로 곡해될 가능성이 높음

보완점.

자신의 잘못을 정확히 인지하고 있다는 점이 선행되어야 합니다. 대리운전 이용내역 등이 양형에 유리하다고 해도 반성보다 먼저 언급된다면 반성문의 작성목적, 진정성이 훼손될 수 있습니다.

무엇을 잘못하였는지 명확히 인지하고 있다는 것을 명시

저는 대리운전 기사가 도착하기로 한 시간까지 10분도 채 남지 않았음에도 술을 마신 채 운전대를 잡는 중죄를 저질렀습니다.

어떤 사정에도 범죄는 합리화되지 않는다는 점을 인지하고 있다는 사실 명시

사건 당일 제 차량이 다른 2대의 차량의 통행을 방해하고 있었으나, 운전자분들에게 술을 마셨다는 사실을 알리고 양해를 구했다면 충분히 이해해주셨을 것입니다. 그럼에도 저는 5m만 비켜주면 된다는 짧고 안일한 생각으로 음주운전이라는 중범죄를 저질렀고, 죄없는 피해자분의 재산상 손실까지 입혔습니다.

~~존경하는 재판장님. 이번 일을 계기로 법의 공정함과 엄중함에 대해 배웠습니다.~~ 앞으로 절대로 이런 일이 발생하지 않도록 절대 운전을 하지 않겠습니다. 매일 반성하고, 또 ~~반성하는 마음으로 매일 반성문을 쓰고 있습니다.~~ 진심을 다해 피해자분께도 용서를 구하고 싶습니다. ~~판사님께도 정말 죄송합니다. 넓은 아량으로 선처를 간곡히 부탁드립니다.~~

문제점 1.

전체적인 초점이 피해자에 대한 사과와 반성이 아닌, 후회와 같은 본인 위주의 감정 위주로 작성되어 진정성을 의심받을 가능성이 높음.

문제점 2.

반성문에 대상이 재판부 위주인 경우, 선처만을 목적(상황을 모면하기 위한 목적)으로 작성한 것처럼 느껴짐

반성의 대상이 재판부가 아닌 피해자임을 명시

충분히 운전대를 잡지 않을 수 있던 상황이었기에 매일이 후회스럽습니다. 피해자분께도 피해를 입히지 않을 수 있었던 상황이었기에, 매일이 송구스럽습니다. 한 순간의 안일한 생각으로 인해 일면식도 없는 분이 피해를 입혔습니다.

피해 회복에 대한 실질적인 노력 및 증거 제시

피해자분께 사죄의 말씀을 올리고자 경찰서를 찾아가고, 법원 민원실에도 전화를 걸었지만 연락처조차 알 길이 없었습니다(대중교통 이용내역, 통화내역 첨부)

반성문을 쓰는 이유와 목적을 명확히 명시

혹여나 법원에 제출한 서류는 피해자분께서 읽어보시지 않을까 하는 마음에 죄송한 마음을 전하고자 이 반성문을 올립니다.
